General terms governing website usage and client service engagements with M1Creative.

Welcome to M1Creative

These Terms of Service ("Terms") govern your access to and use of the website located at m1creative.online, as well as general conditions relating to web design, e-commerce development, brand identity, and SEO services provided by M1Creative Web Consulting ("M1Creative", "we", "us", or "our").

By browsing this website, requesting a quote, or engaging our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By using this website, you confirm that you are at least 18 years of age and possess the legal authority to enter into agreements. If you do not agree with any part of these Terms, you must discontinue using the site.

2. Description of Services

M1Creative provides custom digital solutions for small-to-medium businesses, including hand-coded web development, Shopify e-commerce setups, WordPress website builds, brand identity design, and search engine optimization (SEO) consulting.

3. Project Engagement & Individual Contracts

While these general Terms govern overall website usage, individual paid client projects are governed by a separate, formal Service Agreement / Statement of Work signed prior to project commencement.

In the event of any conflict between these general Terms and a specific signed project Service Agreement, the terms of the signed Service Agreement will take precedence.

4. Payment Terms & Turnaround Summary

Consistent with our transparent pricing model:

  • Setup Fee Structure: Standard project engagements require a 50% upfront deposit before design work begins, with the remaining 50% balance payable upon website completion and prior to final domain launch.
  • Turnaround Commitment: Initial website builds are targeted for completion within 5 business days, subject to timely receipt of client content and approval feedback.
  • Monthly Retainer Plans: Ongoing hosting, maintenance, and optimization plans operate on a rolling 30-day deferred billing cycle starting 30 days after project launch. Retainers may be cancelled with 30 days' written notice.

5. Intellectual Property & Portfolio Rights

Ownership rights for work produced by M1Creative are governed as follows:

  • Transfer of Ownership: Upon receipt of 100% full payment, all custom code, graphical designs, and tailored website assets created specifically for your project transfer fully to the client.
  • Pre-existing Code & Tools: Open-source libraries, frameworks, third-party software, and pre-existing core agency utilities remain subject to their respective software licenses.
  • Portfolio Rights: M1Creative retains the right to display completed client websites, screenshots, and project case studies in our public online portfolio, promotional social media channels, and marketing materials unless explicitly requested otherwise in writing prior to project kickoff.

6. Limitation of Liability

M1Creative builds custom digital experiences following modern performance, accessibility, and security standards. However, to the maximum extent permitted by South African law:

  • M1Creative is not liable for indirect, incidental, special, or consequential damages resulting from website downtime, lost profits, or business interruption.
  • We are not responsible for third-party hosting server outages, external domain registrar issues, or third-party API service disruptions outside our direct control.
  • Clients remain solely responsible for ensuring that text, logos, trademarks, and imagery supplied to M1Creative do not infringe upon any third-party copyright or intellectual property rights.

7. Governing Law & Jurisdiction

These Terms of Service are governed by, construed, and enforced in accordance with the laws of the Republic of South Africa. Any legal disputes arising under or in connection with these terms shall be subject to the jurisdiction of the competent courts of South Africa.

8. Amendments & Updates

M1Creative reserves the right to revise these Terms of Service at any time to reflect legal or operational changes. The latest revision date will always be posted at the top of this page. Your continued use of our website or services following any updates constitutes acceptance of the revised Terms.
